Reason for the nomination:

This photo was taken in Kansas in March 1990.

It was published on the front page of w:The Wichita Eagle on Wednesday, March 14, 1990 and credited to "Dave Williams/The Wichita Eagle "[1] (Williams is credited on many Wichita Eagle photos, so appears to have been staff).

There is no indication that Williams was working as an employee of the US Federal Government or that the photo is ineligible for copyright for any other reason.

As a photo taken in the US after 1989, copyright existed in this photo when it was created. However, the newspaper also included this copyright notice on page 2: "The entire contents of each issue of The Wichita Eagle are protected under the federal copyright law. Reproduction of any portion will not be permitted without our express permission."[2]

There is no evidence that the Wichita Eagle surrendered this copyright.

NWS-created images are automatically public domain in the U.S. since the NWS is a part of the U.S. government. However, the NWS sites also host non-NWS images which have been submitted by individuals: these are generally shown as "Courtesy of ...". Such images have explicitly been released to the public domain by the copyright owner as part of the upload process.
