The image depicts the town's two-story building structures, a gallows (which visually cements Kimberly's importance as a mining boomtown), and the surrounding arid landscape. |

Kimberly was demolished in 1959; no free illustration of the town could be created today, because the townsite has been totally destroyed. The land on which Kimberly sits is now an open-pit mine. This image depicts Kimberly at a point when it was declining but still a viable community; I know of no image of the town which has been released by its creator into the public domain, and since GFDL and similar licenses are recent creations, it is unlikely that any photographer of Kimberly has released them under a copyleft license. |
Minimal use (WP:NFCC#3) | The image is being uploaded at a small size (400px by 262px) and low resolution, enough to illustrate the townsite but not so large that it could be credibly appropriated for commercial sale. The rationale generated her applies only to the photograph's use on a single page, the Wikipedia article for Kimberly, Nevada; its use is not planned on any other Wikipedia page, and if it is used elsewhere, separate fair use rationales will need to be filed for these additional uses. |

The file was downloaded from a site that offers much larger versions of the same photograph for free download; the site offers purchase of prints of the file (in its higher-resolution version), but the existence of the file here does not impact the business of printing the files in any way. The low-resolution copy claimed here under fair use is not of a quality that would allow it to be printed by anyone else in a condition that would be acceptable for sale.
It is not known whether the site from which the photo was taken is also the copyright holder of the photograph. The same rationale holds for any other copyright claimant; this small, low-resolution copy is unsuitable for commercial re-use. |
