Purpose of use in article (WP:NFCC#8)	For visual identification of the object of the article. The article as a whole is dedicated specifically to a discussion of the subject. The use of the picture to the infobox is particularly relevant considering law enforcement's desire to identify the subject, through various means including disseminating this photograph.
Not replaceable with free media because (WP:NFCC#1)	Any derivative work based upon the artwork would be a copyright violation, so creation of a free image is not possible. The individual has refused to be identified or photographed for the past decade, considering this over his reclusiveness and his apparent desire to remain in Canadian custody for as long as possible (which was recognized by the Ontario Superior Court), this makes the prospects of any replaceable image slim.
Minimal use (WP:NFCC#3)	The image is simply used to illustrate the article's infobox.
Respect for commercial opportunities (WP:NFCC#2)	The use of a low resolution image of the photograph will not impact the commercial viability of the art. This is also a mugshot taken under Crown Copyright by a public service (the TPS), which would make any kind of commercial exploitation of the photograph unrealistic.
