Fair use for Gregory Crewdson

[edit]

  1. It is only used for nonprofit educational purposes.
  2. The image is only of a low resolution, and therefore subsequent copies would be of inferior quality.
  3. Due to the image's low resolution and the resulting lack of detail, its inclusion does not lessen its commercial value.
  4. The image's inclusion in the article adds significantly to the article, as it is used to illustrate the style and mood of the artist's work.

Fair use rationale in Emily Tsingou

[edit]

This low resolution image is used in the WP article on art dealer Emily Tsingou, in a section on the program of a contemporary art gallery which exhibited this artist's work - the presentation of this low resolution jpg file adds more than words alone could impart. It is believed that this is fair use and does not infringe copyright. There is no known free alternative available. According to section 107 of the United States Copyright Act of 1976: The fair use of a copyrighted work...for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.

[2] The image is used for non-profit purposes. This factor is noted as relevant by the Act.
