It's a small and quite blurry black and white photo of a quite obscure subject. I don't see any demand for this photo at all, now or ever. FWIW the copyright owner (a public district attorney's office) is not a for-profit entity likely to be seeking out commercial gain from the photo, even if there was any.
Other information The subject of the photograph has been deceased since: April 13, 2009

The original is watermarked "DAUPHIN COUNTY DISTRICT ATTORNEY'S OFFICE" and assuming that's true, it's the work of a government agency -- granted, not a Federal agency which would make it public domain, but still, created used public dollars.
