Fair Use Rationale
[edit]I believe this qualifies as fair use for the following reasons:
- It shows Shider in his prime and wearing his trademark diaper
- It in no way infringes upon P-Funk's rights to the song
- It in no way detriments or detracts from the record label and all the other owner's rights
- Concert footage
- The image was taken from a concert, the audio from which was later integrated into this album, so it is tantamount to a music video.
- This and other videos from this concert have been on YouTube for long periods of time with no objection from P-Funk, so they apparently have no problem with parts of the concert being available.
- Neither the record label that produced the concert, Capitol, nor the record label the song was released upon, Casablanca, have objected either.
- This performance was part of the larger P-Funk Earth Tour and provides a critical perspective on what the tour as a whole consisted of.
- Shider only seemed to wear the diaper during concerts and in private, so obtaining a picture of him wearing one would involve similar copyright issues.
