1) The dress is a unique visual design. Any duplicate would be an obviously inferior knock-off, and using a photograph of one would be misleading to the reader.
2) The dress was haute couture and never commercially mass-produced. None of the copies that are publicly acknowledged to exist are on public display. It is not possible to simply purchase one or visit somewhere to photograph it. |

1) The dress itself is not presently commercially available, so a photo of it can't harm Galliano's ability to profit from the design. Even if it was available, a simple photo can't replace the actual dress. The original was a highly technical design and it is unlikely it could be knocked off on a wide scale based on the photo alone - a photo which is already publicly available.
