Fair Use of image in article: Light Opera of Manhattan
[edit]The image qualifies for the fair use exception to the copyright laws because:
- This photo is being used to illustrate an educational article about the theatre company resident at the theatre, the Light Opera of Manhattan, which performed at the theatre for a decade until the theatre closed in the 1980s;
- The subject of this publicity photograph, the East Side Playhouse, was destroyed, and so the photo is a historic photo that cannot be replaced;
- The persons whose images appear in the photo, Jerry Gotham (choreographer) and the late Raymond Allen (stage actor) are deceased;
- It is a low resolution image; and
- Use of the image will not deprive the copyright holder of any income or opportunities to exploit the image.
Licensing
[edit]This image is a two-dimensional representation of a building or architectural work which has been destroyed, demolished, or otherwise permanently altered in a way that makes it impossible to take a new photograph serving the same encyclopedic purpose. This image is protected by copyright by the publisher of the destroyed architecture. It is believed that the use of low-resolution versions of such images
qualifies as fair use under the copyright law of the United States. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information.
