Summary
[edit]Photograph of horse-drawn coach on Dunmail Raise, Cumbria. Reproduction of a postcard photograph, by an unknown photographer, tinted, published by The Art Publishing Co., Glasgow. Cropped version of image, advertising postcard for sale, at http://uk.ebid.net/
This is a straightforward reproduction of a two-dimensional work of art. The photograph is known to have been taken before 1905 and on these grounds is believed to be out of copyright while the scanning of such works of art is not held, in and of itself, to be creative or subject to copyright. Further, since the image is a reproduction of a reproduction printed en masse, it is not believed to devalue the original work.
Licensing
[edit]This image is in the public domain because under the Copyright law of the United States, originality of expression is necessary for copyright protection, and a mere photograph of an out-of-copyright two-dimensional work may not be protected under American copyright law. The official position of the Wikimedia Foundation is that all reproductions of public domain works should be considered to be in the public domain regardless of their country of origin (even in countries where mere labor is enough to make a reproduction eligible for protection). | ||||
