I asked the Librarian about the license and received this reply:

"Insofar as we know, this book is out of copyright. I have checked the Library of Congress copyright registry and it is no longer listed. No application was made for renewal and copyright expired before the newer and longer terms came into effect. I have also seen it reprinted in anthologies without credit when nearly every other story was included in the acknowledgements page. As part of the University of Texas Utopia project http://utopia.utexas.edu/ we are required to ensure copyright as well and so far, we have had no problems with this text. It has been up for at least 10 years."
