- It is a historically significant photograph of British children, taken prior to World War II who were shipped to various countries and placed into institutions and foster care under dubious circumstances.
- It is of lower resolution than the original.
- It is only being used for informational purposes.
- Because the image depicts a non-reproducible historic event, there is almost certainly no free equivalent. Any substitute that is not a derivative work would fail to convey the meaning intended, would tarnish or misrepresent its image, or would fail its purpose of identification or commentary.
