[edit]This is a clear case of Fair Use for the following reasons:
1. This is an image of a historically significant individual for whom no other photographs exist in the public domain.
2. The photograph used in this 1924 pamphlet was not issued under copyright and thus lies in the public domain.
3. This image is rendered in a low resolution form, a 72 dpi scan of a halftone image, which would in no way impact the use of the image in a higher resolution in a commercial forum.
4. The use of this image greatly improves the article to which it is attached. It depicts the subject of an educational article.
5. The image is of a deceased individual of historical significance.
6. This image represents a tiny fraction of the work from which it is drawn, a small cover graphic. Its use here in no way impacts the future commercial use of that work.
