Fair use for Bristol 450

Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

  1. It is of a historically significant, successful racing car, which won not only its class but also the team prize in the prestigious 24 Hours of Le Mans race in both 1954 and 1955, as well as breaking numerous speed records.
  2. It is of much lower resolution than the original, being a poor quality scan of an original press photo (copies made from it will be of very inferior quality).
  3. The photo is only being used for informational purposes.
  4. Only one of these vehicles still exists, and is in the later, open bodywork configuration. Therefore there is no possibility for the production of a copyright-free image of the car in this, its definitive, record-breaking, late 1953 configuration.
  5. Its inclusion in the article adds significantly to the article because the photo shows well the advanced aerodynamic styling of the bodywork. The Bristol 450 was one of the first racing cars to be designed from start to finish using wind tunnel testing, and laid the foundations for virtually all modern race car design. Therefore, the physical form of the car is of great significance.
