Summary
[edit]Source: http://jonestown.sdsu.edu/?page_id=13941 Core source: NBC news camera recording on November 18, 1978 (raw footage) Author: Bob Brown (deceased), copyright presumed held by NBC Article to be used in: Jonestown or others describing the Port Kaituma shootings
Fair use rationale:
- This is a single image capture from a U-Matic videotape recorded during the Port Kaituma shootings on November 18, 1978. No other real time evidence of the event is known to exist. Recorded by an NBC news cameraman using an RCA TK-76 ENG camera and a Sony BVU-50 U-Matic VTR operated by Stephen Sung.
- This footage has been used by other sources as historically significant, such as PBS American Experience's use of it in the program 'Jonestown'. No recording from the present would contain the same information.
- The image depicts the vehicle used to stage the attacks, as well as a shooter who has just fired a weapon, and these are critical details in the shooting.

Use of historic images from press agencies must only be of a transformative nature, when the image itself is the subject of commentary rather than the event it depicts (which is the original market role, and is not allowed per policy). | |
