Summary

[edit]

Logo of the band The Black Angels. Originally at http://www.theblackangels.com/. The band does not give specific copyright attribution on the site, but presumably they hold the copyright on their logo. Besides the general fair use claim for a group's logo in an article about the group, the article specifically discusses the significance of the logo.

The Black Angels (band)

Portion used

The entire logo is used to convey the meaning intended and avoid tarnishing or misrepresenting the intended image.

Low resolution?

Yes

Purpose of use

The image is placed in the infobox at the top of the article discussing The Black Angels (band), a subject of public interest. The significance of the logo is to help the reader identify the organization, assure the readers that they have reached the right article containing critical commentary about the organization, and illustrate the organization's intended branding message in a way that words alone could not convey.

Replaceable?

Because it is a non-free logo, there is almost certainly no free representation. Any substitute that is not a derivative work would fail to convey the meaning intended, would tarnish or misrepresent its image, or would fail its purpose of identification or commentary.

Other information

Use of the logo in the article clearly complies fair use under United States copyright law. As for Wikipedia non-free content policy, while logo guidelines states "Logos for musical bands are generally not as integral to a band's image as corporate logos are for companies," this is pretty clearly not the case for the Black Angels. Their album jackets and publicity materials never show legible images of the band; they are always clearly intended as works of art, and indicate the band's allegiance to the tradition of such earlier "art rock" groups as the Velvet Underground (from whose lyrics they took their name, and whose vocalist Nico is depicted on this logo). In this particular case, a logo would be far more familiar to the band's fans than any photo of the band themselves.
