Rationale of fair use for Ben & Jason

The image BenandJason.jpg is being linked here; though the picture is most likely originally copyrighted. I, elusive at 16:01, 20 March 2007 (UTC+1), feel it is covered by fair use because:
- The image is a promotional image, previously used on the now defunct official website of the band.
- The image can now only be traced back to an article at indiepop.it and they approve with the use of the image at Wikipedia.
- It's most likely the best (in terms of size and quality) picture of the band presently available on the web, and the picture's purpose for use on Wikipedia is entirely nonprofit and educational.
