Despite the picture being subject to copyright, the linked image is covered by the U.S. fair use laws because:

1. It is a picture of an album cover, representing a small percentage of the actual product. The copyright owners' rights to sell the CD are in no way limited by the inclusion in WikiPedia;
2. Due to the image's low resolution and resulting lack of detail, it could not be used to manufacture illegal copies of the CD or its artwork;
3. The image is used for non-profit educational purposes only, for identification of the album.

It is believed that the use of low-resolution images of such covers solely to illustrate the audio recording in question, on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under the copyright law of the United States.
