Purpose of use |
To illustrate a unique historic event in the life of Samuel Tucker who organized the sit-in and defended the arrestees in court. The photograph is used in a section commenting on and analyzing the historic significance of the event and depicts the actual men Tucker recruited, trained and defended in court. The photo depicts details discussed in the article such as the jackets and ties of the participants who had been instructed to dress well so as to avoid charges of disorderly conduct. The article discusses how the photograph of the sit-in participants in jackets and ties, calmly but resolutely being escorted from the library by uniformed police, is used as a teaching aid in Alexandria, where students from Samuel W. Tucker Elementary have donned similar attire and posed in recreations of the photograph. The use in no way limits the copyright owner's rights. Correspondence with both the Alexandria Black History Resource Center and the Alexandria library has ascertained that neither one claims to be the copyright holder. Florence Murray is credited by the Black History Museum with having taken the photograph. According to Jet magazine (December 17, 1964, p. 25 [1], a Florence Murray (aka Mrs. Florence Shervington) from Alexandria, Virginia died in New York in 1964. No survivors are identified. She is identified as having served as a City Editor of the Washington Tribune and as a correspondent for the Chicago Defender, though no years of service are given. |
