There is no claim that he was a US Federal government employee performing his duties, or that this image is ineligible for copyright for any other reason. As an image made in the United States after 1989, copyright came into being as soon as the image was made. Prior to the NWS's publication of this photo, a version of it (without the embedded caption that appears on weather.gov) was published by Shaw Media explaining how and where the photo was taken, and its significance.[1] Not that it's been required since 1989, but Shaw Media's footer includes an explicit copyright notice: "Copyright © 2024 Shaw Local News Network" The site's copyright policy says "This website (the “Service”) contains material that is protected by international copyright, trademark and other intellectual property laws.
